We at Commen hope you love shopping with us. We try to make your shopping experience as smooth as possible and therefore we have some terms and conditions (“Conditions”) that apply to your order.

Please note, these Conditions apply to consumers. If you are not a consumer, but interested in working together with us, please contact us via our contact details below.

1. Meet Commen

2. Offer and Agreement

  1. When you buy an article online via the webshop of Commen you enter into an agreement with Commen. These Conditions apply to all your online orders and purchases.
  2. We will make sure that these Conditions are easily accessible at the moment you are ordering as well as at any point in time thereafter. You may read, reread or download the then applicable and latest version of the Conditions via our website.
  3. To avoid incorrect delivery following your order, please make sure you provide us with the correct information and contact details. We keep your information safe and process personal data in accordance with our Privacy Policy.
  4. An agreement arising from an offer which contains an obvious mistake and/or error, such as an unusually low price, is not binding upon Commen. Please contact Commen when you doubt the validity of an offer.

3. Price and Payment

  1. The price stated in the webshop is the total price inclusive of value added taxes. Delivery charges are stated separately, if applicable.
  2. If the delivery address is located outside the European Union, additional taxes may apply. It is possible that the country in question charges additional levies, such as import tax. Commen has no influence or control over such levies and can therefore not provide you with further information. Any import duties and taxes payable will be your sole responsibility as customer and may need to be paid at the time of delivery. These additional costs are for your own account. You must check yourself if the ordered articles can be exported and imported to the country in question and what the costs are, before placing such an order.
  3. You can pay for your order using one of the payment methods available in the webshop of Commen.
  4. The Commen gift cards can be used in the webshop.

4. Delivery

  1. Commen aims to process and have your order delivered as smooth and fast as possible. We take great care to ensure that the products are shipped accurately. Should you unexpectedly receive incomplete or damaged products, please let us know as soon as possible, but ultimately within 48 hours after receiving the products and we will take care of this.
  2. Orders are shipped to the delivery address provided by you and via the means of delivery chosen by you.
  3. In the event that a wrong address is provided, the costs for the lost product are for your own account.
  4. Commen reserves the right to adjust the prices of the products and modify the assortment offered on the website at its sole discretion, due to market fluctuations, product ingredient availability and other objective factors. Any such adjustments or modifications shall be made in a reasonable manner and Commen shall not be liable for any resulting inconvenience or harm to you as a customer.
  5. Depending on the chosen delivery method and delivery address, a delivery fee may be applied to the order, which will be clearly indicated before the payment is confirmed and included in the total order price. The price of the product indicated on the website at the time of placing the order is applied to the order. The final price of the product, including taxes and fees, as well as delivery costs, will be indicated in the shopping cart before the conclusion of the relevant product purchase agreement.

5. Quality, legal guarantee & complaints

  1. Commen aims to display products on its website as fully and accurately as possible.
  2. The cosmetic products are not food products and cannot be used for human consumption. Commen has taken all necessary steps to ensure that the design of the products sold and, in particular, their type, smell, colour, appearance, amount or size is not confused with food products and does not pose a risk to human health and safety.
  3. Commen does not allow misleading claims about the effectiveness and other characteristics of the products, as well as complies with good manufacturing practices in the production of cosmetics products.
  4. The products of Commen consists of ingredients included in cosmetics and is safe for human life, health and environment, which complies with the norms of product liability laws and regulations in the Netherlands as well as the relevant applicable international laws.
  5. Commen reserves the right to modify, add, or remove any products offered on the website at any time without prior notice. When you buy a product, you acknowledge and agree that Commen may make such changes in its sole discretion. Commen is not liable to you as a customer for any changes made.
  6. The products of Commen are made from the highest quality materials as listed in the webshop. Should you nevertheless think there is something wrong with your product, please let us know your complaint by email to support@commen.com.
  7. If you have discussed your complaint with us, but you want to file your complaint to another authority, you can contact the Dispute Commission via the European ODR Platform: **http://ec.europa.eu/consumers/odr/**.

6. Right of Withdrawal

  1. Based on the law you have a period of 14 days after receiving the product, to withdraw your agreement with Commen, without giving any reason.
  2. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by sending us an unequivocal statement by email to support@commen.com including at least one photo of the product(s). It is also possible to withdraw the agreement partially. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
  3. Commen will refund the amount paid, including shipping costs, within 30 days after receiving the statement by email as instructed in the previous sub article. In the case of a partial cancellation, we only refund the costs of the concerning product.

7. Return policy

  1. We want you to have the best shopping experience with us, and that is why we don’t have a return policy. In case you are not happy with the quality, then please inform us by sending an unequivocal statement by email to support@commen.com including at least one photo of the product(s) as soon as possible, but no later than 15 days after receipt of all the products in your order.
  2. Commen will refund the amount paid, including shipping costs, within 30 days after receiving the statement by email as instructed in the previous sub article. In the case of a partial issue, meaning a selection of products from the total order, we only refund the costs of the product(s) about which we have received the statement. Commen is free to choose the payment method that complete the refund.

8. Privacy and personal data processing

  1. Commen processes personal data in order to provide you with ordered products and otherwise ensure fulfilment of the obligations set out in these Conditions.
  2. By navigating on the website and placing an order, you acknowledge and agree that Commen is collecting, using and disclosing personal information in association with the Privacy Policy of Commen.

9. Intellectual property

  1. Commen owns all intellectual property rights related to the brand, the product and the website including all promotional materials like video’s and photography.

10. Changes

  1. Changes in these Conditions will be published on the website. You are advised to check these Conditions when ordering with us. These Conditions were published on November 25, 2023.

11. Applicable Law

  1. Dutch law applies to these Conditions and to the agreements between you and Commen. In case of any conflicts, the Court of Amsterdam will decide on the matter; notwithstanding your rights as a consumer that you may have according to the country you are residing in.
